Terms of Service

Version 1.0 · Effective October 31, 2026

These Terms of Service (“Terms”) cover Darby, the phone line at (854) 540-1401, and this website, calldarby.com. “Darby”, “we”, and “us” mean Darby and the company that operates it, named at the bottom of this page. By calling Darby, staying on a call with Darby, or buying a plan, you agree to these Terms and to our Privacy Policy.

1. What Darby does

Darby is an automated phone assistant. It asks you about your job and fills in a building permit application using what you tell it and public property records.

  • An application Darby prepares is a pre-fill, not a filing. You review it, sign it, and submit it to the permitting office yourself.

  • We do not give legal, code, zoning, engineering, or design advice.

  • We do not promise that any permit will be approved, or how long review will take.

2. Who can use Darby

You must be at least 18 and able to agree to these Terms. Darby is for contractors, builders, and property owners preparing permit applications for their own projects or their clients’ projects.

3. Calls with Darby

  • Darby is automated, not a person.

  • Calls are recorded and transcribed so we can prepare and check your application.

  • Our staff may review your application before we send it to you.

4. Text messages

If you agree on a call to receive texts about your application, our SMS Terms apply. Reply STOP at any time to opt out.

5. Plans and payment

We offer two plans. Prices are in US dollars and do not include permit fees charged by your town or county, which you pay to them.

  • Pay as you go: $20 for each application Darby prepares for you.

  • Unlimited: $40 a month for unlimited applications for your own business’s jobs. Unlimited plans may not be shared with or resold to other businesses.

  • Your Unlimited plan renews automatically each month, and we charge $40 at the start of each billing period until you cancel.

  • Cancel anytime by emailing darby@keypermits.com. Cancellation takes effect at the end of your current billing period, and you can keep using Darby until then.

  • If Darby can’t prepare your application, for example because the job is outside the areas we serve, you won’t be charged for it. Otherwise, payments are non-refundable unless the law requires a refund.

  • We will give Unlimited members at least 30 days’ notice by email before a price change takes effect.

  • Payments are handled by our payment processor. We do not store your full card number.

6. Your responsibilities

  • Give us accurate, complete information.

  • Check the application carefully before you sign and submit it. You are responsible for what you submit.

  • Follow the building codes and permit conditions that apply to your work.

7. Acceptable use

Use Darby only for lawful purposes. Do not misuse, disrupt, or try to gain unauthorized access to the service, and do not give us information about other people without the right to do so.

8. Disclaimer and limitation of liability

Darby is provided “as is” without warranties of any kind. To the extent the law allows, Darby is not liable for permit denials, delays, fines, or other losses arising from an application you submit, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

9. Governing law

These Terms are governed by the laws of the State of South Carolina. Any dispute will be handled in the state or federal courts located in Charleston County, South Carolina.

10. Changes to these Terms

We may update these Terms. We will post the new version here with a new effective date. If you keep using Darby after that, you accept the updated Terms.
